Agreed, friend. A further note is that the officer's oath, as in the case of the Commandant, is the same but eliminates "obey the orders of the president of the United States and the orders of the officers appointed over me". It's a straight oath to the Constitution.

As you well know, all military who serve until retirement have taken the oath multiple times, at least once per promotion. AKAIK, a former service member or retiree hasn't been held accountable to that oath, but I, for one, support that they should be. An oath is forever even if the fucking lawyers don't agree.

I'm leery that it's a legit story and strongly doubt the Commandant of the Marine Corps would disrespect the Speaker of the House.

Even if she did ask, his answer would more likely be a simple, "No ma'am, we can't do that without the orders of the Commander in Chief."

Agreed 100%. Unfortunately, and as we all know there were ex-military participating in the insurrection along with Timothy McVeigh's crew being ex-military, AFAIK, they were never charged with violating their oath.

Maybe this assault on our Capitol and attempt to overthrow the nation will see that change.

Larry Rendell Brock Jr, the Grapevine man facing federal charges for his role in the riot at the U.S. Capitol last week, was released Thursday from the Parker County jail.

He made no comment as he rushed into a waiting car.

A federal judge declined to keep Brock locked in jail until his trial. He was arrested by the FBI on Sunday and was charged with knowingly entering or remaining in a restricted building and violent entry and disorderly conduct.

Investigators said images show Brock, 53, on the Senate floor of the U.S. Capitol. In one of the images, he's seen wearing body armor and a helmet while holding zip-tie restraints.

Dallas FBI Special Agent John Moore was the only witness to take the stand.

He testified that Brock was once fired from a job for making racist and threatening comments. The agent also testified to social media postings by Brock where he said, 'I bought a helmet and body armor for the civil war that is coming.'

The New Yorker reported Brock told them he found the restraints and planned to give them to the police.

Prosecutors argued because of his military background skills and actions he should be detained as a threat to the public.

Brock's court-appointed federal defense attorney argued Brock was unarmed, and there's no proof of him causing harm to anyone or damage at the Capitol.

The judge agreed the charges were not enough to hold him.

He did put Brock under strict rules of no possession of firearms, limited online access, and electronic location monitoring.

The judge warned violations could add more federal charges.

NBC 5 Investigates learned Brock is a highly decorated former U.S. Air Force combat pilot with more than two decades of service to his country. On Monday, Brock was lead into a courtroom by U.S. Marshals, handcuffed, legs chained, and dressed in a black T-shirt and jeans. He politely answered questions from a federal magistrate, “Yes, sir."

It is not yet clear if Brock was required to post bond before being released.

The US Marines are not the best people to provide guards. The National Guard would be the direction to go. Luckily, there are now National Guard troops from Maryland, Virginia, and Delaware, now in DC. All three states have Democratic Governors commanding those troops.

DC's National Guard is under trump's command, until noon on January 20th, but it is the most heavily Black/Democratic National Guard in the US, and would not obey unconstitutional orders from trump.

trump might have some more luck with the US Marines, but somehow I doubt it.

Once your time is up you are no longer subject to the UCMJ. I agree with that as we give up many freedoms when we take the oath. That said The oath to me is a moral responsibility not a legal one once one leaves the service.

For non-retirees, I agree. That explains why nothing additional was done to McVeigh and, IMO, will be done to STY.

Military retirement pay differs from civilian retirement pay systems in that there’s no vesting, no matching funds, no interest, and no special retirement accounts. Military retirees abide by a code of laws particular to them called the Uniform Code of Military Justice (UCMJ), which enables them to be court-martialed for misbehavior during their retirement. A military retiree is subject to be obligatorily returned to active duty for reasons deemed appropriate by the military.

How stupid do you think Berger is? There is no way on earth he would say the Speaker of the House had "poisonous lips". She decides whether he gets funding, keeps his job, and what rules he lives by. This is a man who rose through the ranks by knowing how to politely respond to superiors, and he is not going to suddenly lose that now.
