More evidence of Virginia's blueness...

Please show me what documents clearly show that "they" wanted the people to maintain ultimate power? If that were the case, why have a bill of rights, let the people via the elected officials make the rules. Heck with modern technology, we don't even need officials, we can just vote on the rules every few years.

you said that you knew history, apparently better than I do, so please show me where i'm wrong.

the point is... we CAN impeach presidents - and we did - and we can impeach justices.... that power is the constitutional check against judicial activism that goes beyond what the people can stomach.

again, a system designed to prevent mob rule is used to enforce mob rule. and you don't believe that the experience of the founders would have prompted them to add safeguards for our freedom?

I am saying that the ability to impeach a justice or a president IS a safeguard for our freedom.

then kindly explain how the nominations of justices are full of hyperbolic tales of national destruction due to political parties?

That's how it works, the elected officials use hyperbole, but once confirmed the justices are not subjected to such mob rule, checks and balances. THey are originally appointed by an elected official, thus already once removed from popular sentimentality, then they serve for life, with good behavior, thus again removed from the whims of the majority. One of their very important roles is to protect the minority from abuse from the majority. The Bill of Rights is their greatest tool for doing so.

They did add safeguards, one of them being the Supreme Court. Others are in the Bill of Rights, and others are found in additional amendments including the 14th.

and you are that willfully ignorant to see how a republican justice cannot be impeached because a majority of senators are republican, despite clearly ignoring the constitutional rights they are to protect, to believe that this is NOT mob rule?

That has never happened, in fact the only article three judge ever impeached was a Democrat, and he is currently my Congressman, although I don't vote for him.

how is that ability denied by partisanship?

why so obtuse? clearly the gitmo detainee situation is a blatant violation of government limits, yet approved by a divided court, and nobody gets impeached due to partisanship. is that not a denial of our peoples right to control our government?

I did not say it has happened, i've said it wouldn't because of partisanship. I know about Hastings, which further proves my point about partisanship denying constitutional limits and safeguards.

if our elected representatives are not acting in OUR best interests, can we not simply refuse to reelect them?
