There was no 'incorporation'. The Constitution is clear.
The 1st amendment does not apply to the States.
The 2nd amendment has always applied to the States.
So has the 3rd through 10th amendments always applied to the States as well as the federal government.

No court has authority to change the Constitution.
 
Bank robbery is a federal crime because banks are backed by the credit / insurance of the federal government (FDIC). Should states tell their law enforcement agencies to stop responding to a bank robbery because it is a federal crime?
Also because it involves federal currency.
Now, we know if a governor or legislature in some state did that, they'd be turned out of office in short order because the public isn't going to put up with banks being robbed and people easily getting away with it any more than they put up with wholesale looting of businesses.
Yet that's what King Newsom did to the SDTC, and what the oligarchy has done to the SOTNY.
Right now, there are lots of Democrat politicians who think that the public really doesn't give a damn about illegal immigration because they don't give a damn about it. They're coming to the realization that people actually do care and they're going to be fucked if they don't start caring too.

Courts have no power to rewrite the constitution.
 
Federal laws apply, in most cases, to interstate and international affairs. That is things happening between states and between nations. What happens within a state is for the state to handle.

Illegal immigration is an interstate and international affair. The illegal is not a US citizen and entered the US illegally. Regardless of location in the US that makes their presence a federal crime, one the federal government can prosecute anywhere it occurs. That takes precedence over the state.

Kiddie porn can be a state or federal issue depending on how the perp carries it out.
You probably should go read the Constitution of the United States again.
