This is an Ipse dixit fallacy or sometimes called, a bald-faced assertion. That is, you are basing your claim on an unproven assertion and then using that as the basis to reject the argument.

How would it matter if the committee included implacable skeptics? If anything, having one or two on it would lend credibility as they would have presented counterarguments to the rest of the committee's assertions. Having a monolithic committee with a single viewpoint only adds to the argument made by any skeptic of their findings because no dissent was allowed. Having skeptics or adversaries on the committee would strengthen, not weaken, it. Being monolithic like it is only encourages skeptics and adversaries to question their findings more.

In order to rise to a criminal penalty you need to show intent. In order to show intent, you can't argue someone should have suspected something was classified.
