I'm familiar. What elements of that law does Trump meet? Also, court decisions have ruled the nation has to be at war.
I know some posters are going to claim I am defending Trump, but I am just stating the facts about the law. It does not say the punishment for treason is death, it says Congress shall set the punishment.

Examine the elements of the crime:
1. Whoever, owing allegiance to the United States, levies war against them. Trump did not wage war against the U. S. Neither do I think those invading the Capitol were "waging war" any more than the Whiskey Rebellion, the draft riots, the BLM or the Vietnam War riots. Trump could not even be charged with inciting a riot because of the strict standards.
2. or adheres to their enemies, giving them aid and comfort within the United States or elsewhere. Since no one was waging war and the nation was not at war there were no enemies to give aid and comfort.
