Not if they are done within Supreme Court guidelines. Affirmative Action does not require you to hire anyone, it requires you to use a process that seeks a wide field of candidates. You cannot use quotas or use any criteria that would exclude any group.

The process you use would be the same as if you were trying to hire the best qualified candidate. You are not even required to interview any minority applicants.

Yes, it bans discrimination. Affirmative Action does not require anybody to discriminate. It only requires certain procedures to guarantee a wide selection of candidates--exactly what you want for any job search. You have been very misinformed about what AA involves. It is not even a requirement for most jobs.
