Two crimes here. One, the misdemeanor, has already been admitted to. The payment was not for legal services. The other, the campaign fianance crime, has also already been established, Michael Cohen pled guilty to that crime, and Trump was named as a co-conspirator. The second crime makes the first a felony. We have actually seen a good deal of the evidence. Trump lying about making the payment. The checks and the invoices, the Cohen indictment.
So I'd argue that we have seen much of the evidence, much of the crime has already been established, Trump could have been indicted by the Feds the day he left office. Why they decided not to is beyond me.
And luckily we have a court system and appellate system. The evidence?Just remember the grand jury works on a majority vote to indict. Criminal court works on a 100% vote to convict.
