The Mormon church meets on Sundays. We do not have evening services or weekday services. So ... I had to make a choice. I am not going to give up being in church because some right-wing zealot makes me choose.

there is a scotus case about a seventh day adventist....it does seem you have legal grounds for recourse...up to you if you want to take it.

however, if the job requires the work be performed on sunday, i don't think you have a case.

I spoke with a lawyer and he told me that the law was violated. It's more a matter of expense and employment at this point.

understandable. and the lawyer you spoke with is correct. it is up to you whether you want to pursue this. it is your choice between possible loss of job promotion or possible vindication in a lawsuit. it entirely depends on what this means to you.
 
So this is claiming the government can't force someone to work on Sundays? Doesn't say anything about a private company.

Private corporations cannot force an employee to give up his/her right to worship. If anything, the company has an obligation to provide an accomdation to allow an employee to practice his/her religion.

It means quite a bit to me; however, in pursuing it, I risk retaliation. It's a matter of cost vs possible results. Businesses don't usually settle until the are certain they are going in front of a jury. Juries tend to be anti-business. Business knows this and will not settle until it reaches this point.

If I choose to move forward, I will, put this issue before a jury and I will be awarded damages... but that isn't going to get me what I want. I will get a check and my desk contents in a box.

Your company needs someone to work on Sunday. But because you are a bible thumper the company is suppose to hire you and not make you work Sunday because you choose to be out thumping. That makes a lot of sense.

i'm not giving you legal advice..........but.....your lawsuit could help others as well. you may only get damages, but your case (though doubt it will set precedent) may pave the way for others to keep their jobs.......if you win.

They had a Monday - Friday shift available. They failed to make a reasonable accomodation. This is a violation of the law... especially when the hiring manager says "It's ok if you don't want to work Sundays, I have 20 other people who will."

It's blatant discrimination.

that is not the legal issue. the issue is:

does the job actually require the work to be done on sunday.
