Workplace Discrimination - I was victimized!

They had a Monday - Friday shift available. They failed to make a reasonable accomodation. This is a violation of the law... especially when the hiring manager says "It's ok if you don't want to work Sundays, I have 20 other people who will."

It's blatant discrimination.

allright....let's make this clear:

1. can the work that the company needs done, be accomplished on any other day?

2. if not, you have no case.
 
i'm not giving you legal advice..........but.....your lawsuit could help others as well. you may only get damages, but your case (though doubt it will set precedent) may pave the way for others to keep their jobs.......if you win.

Yeah, it may; but I have to wonder ... is it worth the effort? Most businesses are not honest enough to admit their errors and fix them.

Well maybe if you are the most clearly qualified of the 20 and they pass on you but if you are on the same level as all the other candidates and can't work the day they need the help then you're out of luck.

for the record, you talked to a lawyer per your claim. that being:

1. ask him about alternative work days.

2. if the work does not need to be done on sundays, then you may have a good case.

The Mormon church meets on Sundays. We do not have evening services or weekday services. So ... I had to make a choice. I am not going to give up being in church because some right-wing zealot makes me choose.

This isn't a republican issue. That's silly. If anything if they were "religious right" they'd be like Chik-fil-A and close on Sundays. Methinks your target is a bit off, maybe you should aim at the actual cause.

Some people make sacrifices for their beliefs. It seems odd that you would think that such is a "burden" that others should overcome for you.

So this is claiming the government can't force someone to work on Sundays? Doesn't say anything about a private company.

It was a private company, a textile mill in SC. She was fired because she didn't want to work on her Sabbath, couldn't find another job, applied for UC and was denied.
 
LMAO.... the point is that it is pointless to say 'decent wage' or 'living wage'... they are VAGUE and entirely subjective. Be SPECIFIC.

Also... there are certainly times where unions or the threat of a union can get a wage increase. That is fine. The point is that union membership is on the decline, in large part because the primary need for unions no longer exists and people would prefer to be rewarded on merit rather than seniority.

Your company needs someone to work on Sunday. But because you are a bible thumper the company is suppose to hire you and not make you work Sunday because you choose to be out thumping. That makes a lot of sense.

He's already an employee. It's a question of being denied a promotion because he'd prefer not to work on Sundays.

Only knowing what he's said he said the company is looking for someone to work on Sunday's. If you can't work on Sunday's how can anyone expect to get the promotion?

Private corporations cannot force an employee to give up his/her right to worship. If anything, the company has an obligation to provide an accomdation to allow an employee to practice his/her religion.

Where do you get the idea that your employer has to accommodate you? If you're a Christian, then you should thank the Lord you even have a job when millions are out of work and losing their homes and lives being ruiined. Be thankful for what you have and go to church at the evening service or some other day. Surely, your church has more than just one Sunday service.

Federal law ... and State law for that matter ... state they are required to make an accomodation.
