An 8-year-old Port Orange boy is dead after police say he accidentally shot himself while at home with an older brother and a great-grandfather.

Police said the child, who hasn't yet been identified, died about an hour after being rushed to the hospital from a home on Hudson Lane.

The boy was in the kitchen, where he was apparently playing with a 9 millimeter handgun and it went off, hitting him in the chest. It's still unclear to whom the gun belongs, whether it was properly secured or how the boy got hold of it.

"We're going to investigate this and try to find out exactly what happened. Right now, our thoughts and our prayers go out to the child and his family,” Port Orange Police Chief Thomas Grimaldi told WESH 2.

Fayette County Commissioner Vincent Vicites remains hospitalized after being shot, allegedly by his wife, and the district attorney said any talk of it being an accidental shooting is false.

"It is absolutely not an accident," District Attorney Rich Bower said Monday. "This is an intentional, knowing, reckless and/or negligent act where Mr. Vicites could have been killed."

Police said Deanna Vicites, 47, is charged with attempted homicide, aggravated assault and a firearms violation in the shooting of her husband. She is being held in the county prison on $250,000 cash bond, awaiting a preliminary hearing on July 26.

Bower said Deanna Vicites has told "varying and different stories" about what happened at the house.

It's unclear if Deanna Vicites has an attorney who can comment on her charges and the statements made by the district attorney. None was listed on her docket sheet.

Deanna Vicites pleaded guilty in 2003 to a charge of conspiracy to commit burglary. Bower said since she has a felony on her record, she is not legally allowed to possess a firearm.
