An El Paso County Deputy shot a man Thursday evening after a struggle on Falcon Highway north of Ellicott.

Sgt. Mike Schaller with the sheriff's office confirms that a 54-year-old man, David Dean Goss, was shot by the deputy. The deputy is fine, and Goss' injuries are not considered to be life-threatening.

He says there was some sort of a struggle after the deputy contacted Goss along the roadside while responding to a report of a disturbance.

The struggle reportedly involved the deputy's weapon, and that's when he fired.

Four Wichita police officers who shot to death a rifle-toting gunman at the Wilson Estates in east Wichita in November had no choice but to fire, the Sedgwick County District Attorney said today.

Robert Scharoun had already fired his rifle at a newspaper carrier, narrowly missing his head, and had fired another three shots at a nearby house, District Attorney Nola Foulston said today, in a seven-page news release.

Foulston decided no charges would be filed against the officers after reviewing evidence collected by the Kansas Bureau of Investigation, the police department, and her own investigators.

When Scharoun raised the rifle at approaching officers, they fired 21 bullets from their handguns, and another four from a shotgun, hitting Scharoun in the legs, buttocks and head, Foulston wrote.

"It is reasonable, under these circumstances, for the officers to respond to Scharoun's unlawful use of deadly force by firing at him in order to protect their own lives or the lives of others," Foulston wrote.

Preparing for his job as a SEPTA bus driver early Friday, Eric Crawley, 39, of East Mount Airy, received a phone call saying that his younger sister and her boyfriend were fighting and that the man had hit her, his relatives said yesterday.

About 10:20 a.m., Crawley went to the 7900 block of Rugby Street, where his sister lived. His mother was there, too.

Patrol officers were quelling the dispute, police said.

Crawley had a licensed handgun on his hip.

"The officers told him not to remove the gun, but he removes it," said Lt. Ray Evers, a Police Department spokesman. "They told him to drop it, and he did not."

One of the officers fired once, hitting Crawley in the chest, Evers said. Crawley fell in the street a few feet from his car, with his mother and sister over him. He was pronounced dead at Albert Einstein Medical Center.

"The officer took the appropriate action," Evers said.

A police chief and sheriff's deputy have been cleared in the fatal shooting of a man in Montcalm County earlier this month.

Matthew Speese, 47, died after being shot in the head June 1 outside his home in the 20500 block of W. Gates Road in Reynolds Township.

Montcalm County Prosecuting Attorney Andrea Krause has determined Howard City Police Chief Steve DeWitt and Deputy Clayton Thomas acted properly in self-defense.

Police went to the residence after someone called 911 and asked to check on Speese's well-being.

He was threatening to kill himself and would shoot police officers if they responded.

Officers from multiple police agencies were then confronted with a Speese who had a long gun, according to the prosecutor's report.

Police tried negotiating with Speese, who was reportedly agitated and occasionally swearing at them.

Speese did not comply with the many police commands to drop his gun.

Speese kept walking toward police with the gun held in both hands leveled waist high, according to the report.

Chief DeWitt fired one round at Speese from his.223 rifle.
