A Pottstown man who admitted to attempting to kill a 14-year-old boy by shooting him in the back on a borough street will be behind bars for more than a decade.

Donte Marcellus Banks, 20, of the 300 block of North Charlotte Street, was sentenced in Montgomery County Court to 11 ½-to-23 years in a state correctional facility after he pleaded guilty to felony charges of attempted murder and carrying a firearm without a license in connection with the Nov. 21, 2010, shooting that occurred in the 300 block of Chestnut Street.

The sentence was imposed by Judge Thomas P. Rogers.

“You had a child running away and an adult took out a gun and shot him right in the back. This act is one of the most cowardly and despicable acts,” Assistant District Attorney Nathan Schadler, who argued for a lengthy state prison sentence against Banks, said on Wednesday.

The fatal shooting of Chad L. Harris in March by two Kalamazoo Department of Public Safety officers was justified, KDPS Chief Jeff Hadley said in a statement issued Wednesday afternoon.

Hadley said two separate investigations and a review of the case by Kalamazoo County Prosecutor Jeff Fink cleared officers Steve Heyduck and David Moran of any wrongdoing in the March 29 incident.

Investigators said Heyduck fired a handgun and Moran fired a shotgun at Harris, 42, who was armed with a knife and advanced toward Officer Brian Cake, who also was at the scene.

“Chief Hadley found that officers Heyduck and Moran acted lawfully and in compliance with Kalamazoo Public Safety policy,” Hadley's statement said. “(Hadley) concluded that officers Heyduck and Moran were completely justified in their use of force.”
