EU launches legal action over UK plan to extend Brexit grace period

The EU has formally launched legal action against the UK, alleging that Boris Johnson has broken international law over Brexit implementation in Northern Ireland.

It is the second time in six months that Brussels has launched infringement proceedings against the UK over Brexit, following last year’s threat by the British prime minister to override part of the withdrawal agreement through the internal market bill.

UK to lift cap on nuclear stockpile

The UK is set to reverse plans to reduce its stockpile of nuclear weapons by the middle of the decade, as part of a foreign policy overhaul.

Outlining the strategy to MPs, Boris Johnson said after Brexit the UK would have to "relearn the art" of competing against countries with "opposing values".

Public support for a statutory public inquiry into the UK’s handling of the Covid-19 pandemic is running more than twice as high as opposition to the idea, exclusive polling for the Guardian has revealed.

As a growing number of doctors, nurses, scientists and the bereaved call on the prime minister to trigger a formal independent investigation, 47% of people said they supported a public inquiry which has legal powers to compel people to give evidence under oath. Only 18% said they were opposed. 35% said they neither supported or opposed it or didn’t know, according to polling carried out by ICM last weekend.

Nicola Sturgeon 'misled' Holyrood, inquiry concludes - First Minister urged to resign NOW

NICOLA Sturgeon "misled" the Scottish Parliament over her knowledge of Harassment Complaints against her predecessor, a Holyrood inquiry has concluded.

Sturgeon quizzed after conclusion of Alex Salmond inquest

A government committee investigating the botched handling of complaints against Alex Salmond published it's conclusions this morning. The Committee on the Scottish Government Handling of Harassment Complaints was set up after a successful judicial review by Mr Salmond resulted in the Scottish Government's investigation being ruled unlawful and "tainted by apparent bias" in 2019.

Mr Salmond was awarded £512,250 in legal fees after the Scottish government conceded the case a week before it was due to be heard in court because of prior contact between the investigating officer Judith Mackinnon and two of the women who made complaints.

A Scottish Government policy for handling harassment complaints was drawn up in the wake of the Me Too movement and was designed to include former ministers in the complaints process for the first time with Ministers also being responsible for the policy.

The inquiry held 14 evidence sessions with key members of the Scottish Government including Ms Sturgeon, Permanent Secretary Lesley Evans as well as former Scottish First Minister Alex Salmond.

The inquiry explored various elements development of the complaints policy that was used unlawfully, the handling of the allegations, Mr Salmond's successful judicial review and the ministerial code.

Mr Salmond and Ms Sturgeon were at loggerheads as Mr Salmond accused Ms Sturgeon of several breaches of the Scottish Government ministerial code and lying to parliament over meetings between the pair in 2018 regarding harassment claims made against Mr Salmond.

Ms Sturgeon has always denied the allegations and branded the claims “conspiracy theories” and an independent review by James Hamilton QC cleared the Scottish First Minister of any breaches of the ministerial code.

However, in the final report, published this morning, the inquiry concluded that Ms Sturgeon gave an "inaccurate" account of her meetings and phone calls with Mr Salmond about the investigation.

The Holyrood committee also found it "hard to believe" Ms Sturgeon's evidence of when she first heard about concerns relating to the former first minister's alleged behaviour.

The Committee said in their report that Ms Sturgeon's written evidence was "an inaccurate account of what happened, and she has misled the Committee on this matter" over when she first knew about Harassment Complaints against the former Scottish First Minister.

The report said: "The Committee notes that there is a fundamental contradiction in the evidence in relation to whether, at the meeting on 2 April 2018, the First Minister did or did not agree to intervene.

"Taking account of the competing versions of events, the Committee believes that she did in fact leave Mr Salmond with the impression that she would, if necessary, intervene."

The Committee said it was a "potential breach of the Ministerial Code under the terms of section 1.3."

Ms Sturgeon previously said she had been told about the allegations by Mr Salmond himself during a meeting in her home on April 2, 2018.

However, it was later found that Mr Salmond's former chief of staff Geoff Aberdein had met with the First Minister in her Holyrood office four days prior to that, where she was told of the complaints.

The Committee also said on her knowledge of complaints prior to November 2017: "The Committee finds it hard to believe that the First Minister had no knowledge of any concerns about inappropriate behaviour on the part of Mr Salmond prior to [that time].

"If she did have such knowledge, then she should have acted upon it. If she did have such knowledge, then she has misled the Committee."

The Committee overall concluded the Scottish Government’s handling of harassment complaints, and the subsequent judicial review was "seriously flawed".

However, four SNP members of the Harassment committee members did not agree with the finding that she misled the committee.

In a statement, this morning, they claimed "some evidence to the inquiry indicated that the former first minister could display bullying behaviour" but "there has been no suggestion the First Minister was aware of sexual harassment".

On the judicial review, the Committee said the Scottish Government was "responsible from an early stage for a serious, substantial and entirely avoidable situation that resulted in a prolonged, expensive and unsuccessful defence of the legal challenge."

Legal advice released by the Scottish Government earlier this month revealed the Scottish Government's own Counsel warned Mr Salmond's case was “more likely to fail than succeed” on October 31, 2018 and “the least worst option” would be to concede on December 6, 2018.

But the Scottish Government insisted on fighting the case and did not concede to Mr Salmond until January 8, 2019.

On the Scottish Government’s handling of complaints, the Committee said the multiple roles being fulfilled by the Permanent Secretary during the complaints process should have been "seen as a risk."
They recommended that to ensure confidentiality of the process, they expect the Scottish Government to undertake a thorough review and implement demonstrable measures.

Finally, on the development of the Government complaints procedure, the Committee urged the Scottish Government to introduce an independent support service and an independent system for reporting and investigating complaints.

The Committee also warned more time should have been taken over the drafting of the procedure which would have allowed time to develop supporting guidance providing more support and information for those involved in the process including complainers.

Nationalist MSPs Alasdair Allan, Tom Arthur, Linda Fabiani and Maureen Watt, independent MSP Andy Wightman all sat on the Committee along with Tories Murdo Fraser and Margaret Mitchell, Scottish Labour's Jackie Baillie and Scottish Liberal Democrat Alex Cole-Hamilton.

Linda Fabiani MSP, Committee Convener, said: "These women were badly let down by the Scottish Government, but they have also been let down by some members of our Committee. I am truly dismayed by the hurt some of the Committee leaks will have caused them.

"I apologise to them unreservedly. This is not who we should be as a Committee of this Parliament."

MSPs from across Holyrood and from the Committee expressed their horror at the report, which one member claiming it was a "sober read."
