DUI truckdriver who killed 5 bicyclists NOT charged with murder

I take a lot of shits during the day.

And every post to me takes away a little bit of your soul. Do you watch your shit being taken away from you while you flush? Do you have a sense of loss? A sense that life isn't worth living?

He'll get a 5 year sentence and do half of that as america continues to coddle these killers. The monster has an american-sounding name but he looks like an illegal.

Apparently you, and CBS, does not do their homework.

This driver is charged with five counts of DUI resulting in death, DUI, and reckless driving. This immediately suspends his commercial driver's license, and he will never get it back until his time is served and his record expunged, should he be convicted.
The minimum penalty for these crimes is 2 years for each DUI, accumulative. In other words, a minimum of 10 years. The maximum is 20 years accumulative, or possible a life sentence, effectively.

It is not a murder charge in the State of Nevada. The driver will face trial in Las Vegas, in a Clark County court. Judges there are very harsh against DUI of any kind. He is currently being held in Kingman, AZ until his extradition to Nevada.

That said, highway 95 is NO place for bicyclists, even with a pilot car (which they had). This is a very busy high speed two lane highway with no shoulders sufficient to separate bicycles from traffic (other than dirt and gravel, which the cyclists won't use). This is a VERY dangerous road for any kind of activity like that. There is NO bicycle lane at the location. It would too dangerous to even consider installing one. The organizers of this event are being extraordinarily stupid.

"Share the Road' makes for a poor epitaph.

The name "Barson" is Norse in origin. Illegal aliens cannot get a commercial driver's license. People with a DUI conviction cannot get a commercial driver's license.

Oh, and Mexicans are also American. So are Canadians, Brazilians, Venezuelans, Cubans, Argentinians, etc.

No, this poor sap is going to spend a very long time behind bars. Upon conviction, the judges have no authority to imprison for less than 2 years per such conviction. The prisons are specifically directed to not allow time off for 'good behavior' in these cases either.
He can also be required to undergo drug rehabilitation treatment by the Court, in addition to his prison sentence. This poor sap has really fucked up his life.

Bicyclers aren't people, he did the world a service.

They are people, but in this case, they were very stupid people. Highway 95 south of Boulder City, where this accident took place is a VERY dangerous place to ride a bicycle. The organizers of this event were being very stupid. It was only a matter of time before an accident like this took place. It suppose the only consolation is that the driver was DUI, and will be probably be convicted, serving anywhere from 10 years to life in Nevada State prisons.

Why should he be? The bicyclists were riding in the middle of the highway posted for 75 mph. If they were too stupid to stay on the shoulder and out of traffic moving that fast that's on them.

As an aside, I was driving down Arizona 79 a few years ago at roughly 75 mph in a truck towing a trailer and loaded with about a ton of tools and building supplies. I came over a hill and there were between 20 and 30 bicyclists, followed by a van with it's blinkers on, doing all of about maybe 10 mph. I couldn't pass because of oncoming traffic and nearly rear ended the van which would have catapulted forward into the bicyclists.
I immediately called the Pinal County Sheriff's via 911 to report this illegal and incredibly dangerous bullshit by these retard bicyclists. I hope the whole group got whopping massive criminal tickets for that shit because they deserved it creating what was a huge safety hazard.

Yup. Well, in this case, the bicyclists got the death penalty. A tragic outcome nevertheless.

You don't fuck around on these desert highways. The laws of physics is pretty hard to ignore.

I don't know where they were on the highway and neither do you but they had a right to be there. This is one more reason we need to lower the speed limit to 45. If this nut had been doing that speed he could have avoided crashing into them.

Sure. They had a right to be there. They also had the stupidity to be there. SR95 is an extremely dangerous road to ride a bicycle on. This is out in the desert. No one is going to drive 45 on this road. The speed limit (which is never really enforced anyway here) is 75. Typical speeds here often go up to 80 or 85.

The truck driver was asleep and DUI. A 45 speed limit would not have prevented the accident.

Don't ride bicycles down fucking dangerous high speed two lane roads. That's just a death wish.

What does states rights have to do with this?. I agree highway homicide is an issue to be left to the states and the states should make it murder when a DUI kills someone. Don't give me that "this was an accident" crap. THINK, you deranged demented despicable degenerate TRANNY.

You are in the wrong here, dude. The State of Nevada has all the authority it needs to set their own State laws concerning highway use on State highways (which SR95 is), including establishing DUI laws and murder laws.
Before you go spouting off shit you don't know again, read the Nevada statues concerning DUI resulting in death or dismemberment. Read the penalties for it. Examine that stretch of SR95. I've driven that road a lot. It is a fucking dangerous place to ride a bicycle. Only an idiot would do that or organize an event such as this.

You have the legal right to ride that bicycle there, but you also have to suffer the consequences should you be so stupid.

I am still trying to figure out why there are any allowable levels of meth... "Blood tests showed Barson had nine times an allowable amount of methamphetamine in his system, Bauman said."

Methamphetamine is an illegal drug, except in Oregon. There is no 'allowable level of meth'. It is the news media fucking up again.

Depending on state law... In Arizona you have to ride in the first 3 feet of pavement from the curb or edge of pavement, period. You cannot take up the entire traffic lane with your friends and pedal down a highway at 10 mph or so when traffic is doing 70 to 80 mph. It was the bicyclists in my case that were TOTALLY at fault. They were riding illegally contrary to Arizona state law. The van following them was operated contrary to Arizona state law too. You can drive too slow on a road like that van was doing.

Now, if it were an Interstate highway in Arizona, riding a bicycle on it at all is a misdemeanor. Bicycles and pedestrians are not allowed on Interstate highways whatsoever.

That is true in Washington as well. That said, we have quite a few State highways that bicycles are allowed on, but it's VERY stupid to ride there. On the Wet Side, problem roads are SR3, SR202, SR203, SR2, and SR530.
Oh...and several of these roads parallel perfectly good actual bicycle paths, that are even more scenic.

Farm roads and State highways is NO place for a bicycle. It's only a matter of time before you are injured or killed. The laws of physics trumps laws of government.

"Share the Road" makes a poor epitaph.

We all have to deal with mild inconveniences. It is a sign of the time that so many people are such complete narcissists that they think death should be the punishment for inconveniencing them.

It's not about convenience, dumbass. It's about being stupid enough to ride a bicycle on a farm road or narrow high speed State highway.
Road workers that don't properly mark their work site or flag it properly stand to lose life and limb as well.
Truckers that refuse to allow traffic to pass by not using turnouts or are blocking all lanes are creating a hazard and are driving illegally. In some States they can lose their commercial driver's license for that.
