The Constitution not only describes and defines the federal government, it delineates what powers the federal government has and all rest resides with the States, or the People.

Each State has a right to exist as a State of the Union.
The Union is not a State, but it is a nation.
A State does not have to belong to the Union. Any State has the right to secede from that Union at any time. If they do so, they are an independent nation. They may even form a union under another government as a State in that union. That union is a different nation.

More interesting would be, what if this guy had THC in his system? Would he be charged the same way for having smoked pot two days prior?
 
They are people, but in this case, they were very stupid people. Highway 95 south of Boulder City, where this accident took place is a VERY dangerous place to ride a bicycle. The organizers of this event were being very stupid. It was only a matter of time before an accident like this took place. It suppose the only consolation is that the driver was DUI, and will be probably be convicted, serving anywhere from 10 years to life in Nevada State prisons.

It depends on where they were. A lot of 95 has a paved shoulder like this:

Plenty of room to ride on the shoulder and even a rumble strip to warn cars they're drifting off onto the shoulder.

And there are older parts that haven't been upgraded yet like this:

As you can see in this photo of the site, the bicyclists should have been on the shoulder of the road and not in the middle of it with a slow moving "chase vehicle." They created an unnecessary hazard on that highway.

The article specifically says there are prosecutors, and they have filed 12 felony charges against the truck driver. If you have some better information, feel free to post it. But, I am not going to just take your word for it. After all, you claimed there was no such thing as viral pneumonia.

Most of SR95 hasn't been upgraded to have paved shoulders and it won't be anytime in the near future. This includes the stretch of road they were going to ride on (and never made it!). This section, which is a divided highway, has narrow shoulders. Still a pretty dangerous to ride a bike with high speed traffic so close and nothing between you and it but a rumble strip.

The article is wrong. No prosecutor is assigned to this case. Yes, charges are filed, by the prosecutor's office, but that is an office, not a prosecutor.

Farm roads and State highways is NO place for a bicycle.

Farm roads often have slow moving farm equipment, in fact that is one of their purposes. If you are driving too quickly to stop in time for this equipment, the fault is on you. Maybe you should stop racing around on farm roads, and leave them for what they are meant to be for.

By the way, one of the original reasons for farm roads is for bikes.
 
Why should he be? The bicyclists were riding in the middle of the highway posted for 75 mph. If they were too stupid to stay on the shoulder and out of traffic moving that fast that's on them.

As an aside, I was driving down Arizona 79 a few years ago at roughly 75 mph in a truck towing a trailer and loaded with about a ton of tools and building supplies. I came over a hill and there were between 20 and 30 bicyclists, followed by a van with it's blinkers on, doing all of about maybe 10 mph. I couldn't pass because of oncoming traffic and nearly rear ended the van which would have catapulted forward into the bicyclists.
I immediately called the Pinal County Sheriff's via 911 to report this illegal and incredibly dangerous bullshit by these retard bicyclists. I hope the whole group got whopping massive criminal tickets for that shit because they deserved it creating what was a huge safety hazard.

That is an actual incident. I was driving from Phoenix to Oracle Arizona and just South of the Chaparral Steakhouse on 79 when it occurred. I have two lots on "First" Timberline off Mt. Lemon Highway there. You can look all that up on Google Maps if you want. The incident is described accurately.
