I told you sycophants the constitution was clear!

You are full of shit. When Indians killed other Indians we let them work it out. When Indians killed an American the federal government prosecuted them.

The Major Crimes Act of 1885 or (18 U.S.C. § 1153), enacted as section 9 of the Indian Appropriations Act, 1886, Major_Crimes_Act Original Statute-is a law passed by the United States Congress. The law places certain crimes under federal jurisdiction if they are committed by a Native American in Native territory. The law follows the 1817 General Crimes Act,a which extended federal jurisdiction to crimes committed in Native territory but did not cover crimes committed by Native Americans against Native Americans.

Elk, 1884 but he was born in the rez well before that. Dumbshit!

Then I will Admit I was wrong about my prediction.
It would not be the first time, but im not wrong.

I will continue to believe what I believe, unless they write an opinion I find persuasive.
From what we've seen in the past, it is more likely you will avoid the site for a while and then never speak of your prediction. However, if by chance your flipped coin landed on its side this time, and they do as you predicted you will be on here like desh after three decades of predicting doom to tell us that you were "right"...

Too many people make a living on being wrong about predicting their rulings based on the questions. Almost none of them tell you their on base percentages.

The Senecas has BOUGHT some of its land but most of it's land is owned by the Federal government and is held in trust for them.

  • Trust Status: While the Seneca Nation operates as a sovereign nation, much of their land is held in trust by the federal government.
YOU might be right for other tribes but the Senecas actually own their land NOT the federal government.
Do a search and see.

Yes
Yes, the Seneca Indians own the land on their reservations in New York State. The Seneca Nation of Indians is a federally recognized tribe that holds sovereignty over their territories, which include the Cattaraugus, Allegany, and Oil Springs reservations. They have historical claims to these lands and maintain governance over them, as established through treaties and constitutional conventions.

And I was talking to several Senecas last night and they all say they own the land their Rez is on NOT the Federal gov.

I disagree, but I’ve no problem with you sharing your ‘opinion’.

My opinion on the Constitution is the same before the questions as after.

The Federal government has always enforced federal laws on the reservation Dumbshit. And even Indians born off the reservations were not considered American citizens until 1924. Why did it require an Act of Congress to grant all Indians citizenship. Shouldn't the 14th amendment covered them?

Citation?

It took an act of Congress because native people lived on sovereign land.

They listed Wong Ark's parents' domicile and legal status in the US when Ark was born. They also list Elk parents as members of the Winnebago sovereign government and cited that as reason why Elk owed his allegiance to another government. So yes central.

Where does the constitution list requirements for parents?

Elk was born in a separate sovereign land.

Elk was not under the jurisdiction of the US.

Elk was not born to US Sovereignty, Wong Ark was.

AI Overview

Native Americans born off a reservation before 1924 were not automatically considered U.S. citizens. Even if born outside a reservation, tribal members were often legally viewed as citizens of their own sovereign tribal nations rather than American citizens, a status affirmed by courts ruling that the 14th Amendment's birthright citizenship clause did not apply to them

Then the consideration was unconditional. The cases that went to the S.Ct proved that.

The Indian Citizenship Act of 1924 (43 Stat. 253, enacted June 2, 1924) was an act of the United States Congress that declared Native Americans born within the United States are US citizens. Although the Fourteenth Amendment to the U.S. Constitution provides that any person born in the United States is a citizen, there is an exception for persons not "subject to the jurisdiction" of the federal government. This language was generally taken to mean members of various tribes that were treated as separate sovereignties: they were citizens of their tribal nations.

Being born off the reservations did not change their status as members of their Indian tribes. Mexican babies born to two legal Mexican citizens are considered citizens of Mexico regardless of where they are born. Mexico is a sovereign country.
