As an attorney you know how inappropriate it is to suggest that simply remaining silent is an admission of guilt. I would recommend to anybody at all getting questioned by anybody with an objective to take them down to simply remain silent.

If you are President of the USA and you are under questioning, you would say things like "that depends on what the definition of is is".. or "I do not recall"...

The reality is, remaining silent or saying nothing while talking a bunch have little to no difference.

Another reality: If you were his attorney you would tell him to remain silent.

I know for a fact folks at that level far more often get in trouble getting caught in a "lie" during testimony (one that usually is them just forgetting something then remembering later) than they ever do for the supposed crime they are supposed to be investigating. Even in innocence silence is golden.

I absolutely would tell any guilty client to take the fifth. If I’m not acting as an attorney I’d point out what taking the fifth means. It’s a criminals right not to incriminate himself, but the fact of taking the 5th You are saying that what you would say would be incriminating.

That is also incorrect and you flat know it.

Remaining silent is your right and cannot be used as evidence against them, it is legally unethical and you flat know it. If you tried to bring that up as a reason to bring him to trial you would fail and you may be censured.

More often than not those who are put in prison for crimes they did not commit are there because they talked when they should have remained silent.
