Criminals have rights, just as any person. If they've had a hearing, which determines they are illegal aliens (even if being tried for something else!), they can be deported.

The Florida case was NOT by any federal officers or ICE. It was by the Florida State troopers and was not a federal action or detention. The 'law' the troopers used was itself unconstitutional. He was held 24 hours before being released by a federal court order.
