If the box states that it doesn't filter anything smaller than .3 microns then it would not be able to classify itself as an N95 mask under NIOSH regulations and would be in violation of the law by claiming they were an N95 mask.
It seems you can't read and don't understand what the box actually says. Masks are tested with .3 micron because that is the size particle that is hardest for a respirator to stop. Larger and smaller particles are easier to stop.
This is a standard graph showing the effectiveness of a filter. Notice how the larger and smaller particles are much easier to stop then the .3 micron particles.
