No, that part was a good idea.
The problem comes when judges think they can make up law as the go (aka ruling from the bench).
That's what we're seeing right now, and that's what the problem is.
Then why on appeal are these judges getting overturned more often than not?Doesn't seem like the current administration agrees with you.
No one is making up laws. Last I checked they are merely ruling on whether the application of various laws (or lackthereof) is legal. That used to be their job.

One case in something like 100,000 + at this point. Even if he's returned, he gets fucked and ends up right back in prison with an order of deportation slapped on him. Even if the judges get their way, they lose.That's how the system works. It can't work any other way.
Besides, SCOTUS ruled 9-0 to bring Abrego Garcia back. There is no appeal from that.
