The Fourth Amendment does say:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

In general, beyond that the Constitution does imply a certain amount of due process, and democratic norms for elected officials.

We could argue which period of time had the lowest quality of people in Congress in all of American history....is it now or was it in the run up to the civil war.

I say it is now.

In the run up to the Civil War, there were many fine members of Congress, who wanted to do the moral things. They were blocked by the Southern elite, but the Southern elite had a harder and harder time blocking them. That is why the Southern elite finally gave up, and declared war on the USA.

Today, there are also many fine people in Congress. They just are not in your party.
