Nope. SCOTUS has ruled consistently that the first ten Amendments, the Bill of Rights, is superfluous. The Rights of the People are given by their Creator, as stated in the Preamble, and the Constitution describes and severely limits to power of FedCo. The Bill of Rights simply enumerates certain Rights to make it crystal clear to folks like you, "a sect preaching up & pouting after an English constitution of king, lords, & commons, & whose heads are itching for crowns, coronets & mitres. But our people, my good friend, are firm and unanimous in their principles of republicanism..."

It is in the Declaration of Independence and you did say he claimed it was in the Constitution, which is wrong. The preamble is not the Constitution.
