Rights are guaranteed by the Constitution. It seems you don't understand what a guarantee is vs what a right is.

The right to self defense doesn't guarantee you can own a gun any more than the right to self defense guarantees you can own a nuclear warhead. Both are weapons you can use to defend yourself.

How many foreigners are currently in US jails? If there is more than zero then clearly they are subject to US jurisdiction.
I'll give you a hint, there are a lot more than ten thousand in US jails. If the USSC rules that they are not subject to US jurisdiction then the US would be jailing them illegally. Not only would they be immediately freed, they could sue the government for hundreds of millions if not billions for being illegally held in violation of US law and the US Constitution. Treaties allow for foreigners to sue the US government.


Why do you think the US used Guantanamo for holding Al Qaeda members? It was to prevent them from being subject to US jurisdiction if they were being held inside the US.

Everyone on US soil other than foreign diplomats are subject to US jurisdiction. No sane court will rule otherwise because the consequences would be catastrophic for the US.
If the 14th Amendment says everyone born here by parents from other countries is automatically a citizen, why didn't the authors of the Amendment simply say that without adding..."and under the jurisdiction thereof".

You also need to understand that the Civil war had just been fought over the question of if the Union had jurisdiction over the Southern States so they wanted to emphasize that citizenship was related to Jurisdiction, and wanted to force the Southern States to ratify that concept.
 
But also subject to the Jurisdiction of the United States, its not one or the other. If they were not subject to our jurisdiction we would not be allowed to arrest them or even deport them.
