How do you determine who is illegal?

I did not say its unimportant. Its not part of my job, if there is an issue it would be the other side's job.

I wish American teachers understood our Constitution better.

You said it doesn't matter ...that you just believe that they say who they are... That's not very professional.... It would be wrong to waste the court's time when there would have to be an entire new trial... How is it not part of your job to properly screen your clients ?

It is not my job, that is why we have an adversarial system.

I wish Americans teachers understood the Constitution better.

If you refuse to identify yourself, you are looking at being arrested next and then taken to the police station where they will identify you whether you cooperate or not.

I posted one of those "Sovreign Citizen" traffic stops where the person stopped did exactly what you stated above. That ends with the person being cuffed up, read his rights, and off to jail you go until you're identified by the police. You can clam up all you like, but it doesn't buy you much if anything other than trouble.

Sovereign Citizen morons notwithstanding. If I'm standing on the side of the road and some cop doesn't like the look of me and demands identification they do not have a right to just arrest me when I refuse. The police have lost a large number of lawsuits about this.

Someone driving, they need to give a driver's license if they are pulled over by an officer for cause, and many (if not all) states issue licenses to folks that are illegal. They do not have to answer any questions, if the officer arrests them because he simply doesn't like that they do not speak English and/or refuses to answer questions they will lose in court, have consistently lost in court, and most officers go through some training nowadays to learn how to deal with folks that do 1st and 4th amendment "Audits".

Because its an adversarial system, my job is to prove my case. The other side's job is to identify weaknesses or missing elements and show that to a jury.

I care, but Ive never been suspicious of any of my clients on that issue.

Bottom line...Everybody should be willing to show an ID... If you are guilty of nothing it should not be a problem... it takes two seconds...If you are guilty of something then you're going to have to accept that responsibility.... (We just recently had an incident here where a child was released to
An individual who was not their parent... They had a few pictures with them...that was it.... Proper identification is kind of important...)

I agree that in some situations identification is important.
At my kids school, everyone knew me well, but they still usually asked for ID and I appreciate that policy.

Should Banks trust everyone that are trying to cash a check are who they say they are?
