The bank gets the property appraised, the appraisal is not based on what Trump (or you) says, but by official appraisers reading government documents and then using approved appraisal methods. This is one thing that cannot really be lied about, there are actually documents the builders got when your property was built called permits that list things like how many square feet are there, how many rooms, bathrooms, etc. Trump saying it is bigger would not change the result of the appraisal.
This isn't fraud. There is no victim here. The bank gave him a loan based on the appraised value of the property, not based on what the owner guessed it was worth, even partisan lawyers know that this is true, but they won't admit it because they are partisan.
