Remaining silent is your right and cannot be used as evidence against them, it is legally unethical and you flat know it. If you tried to bring that up as a reason to bring him to trial you would fail and you may be censured.

More often than not those who are put in prison for crimes they did not commit are there because they talked when they should have remained silent.

Agreed on the Fifth Amendment. Bottom Line: Trump is a fucking hypocrite and probable criminal. Due process applies.

As for those in prison, some have a sense of honesty and a desire to put things right. Most were simply caught and pled out for less time in prison.

You do not have a right to take the fifth amendment if you are not liable to be criminally prosecuted. For example if you have been granted immunity for the crimes you are possibly incriminating yourself for, or if the statute of limitations has passed, you do not have a right to remain silent. You do not have the right to remain silent only because you’re afraid you might perjure yourself.
 
As an attorney you know how inappropriate it is to suggest that simply remaining silent is an admission of guilt. I would recommend to anybody at all getting questioned by anybody with an objective to take them down to simply remain silent.

Secondly, for both of you, why shouldn't innocent people cooperate with their local governments in catching criminals? If the system is broken then fix it.
 
It is not a civil case when they are trying to criminally charge him. This was the reason that Clinton lied during his testimony, BTW and why he lost his license. He was not at a criminal trial.

Basically, if you tried to use "he wouldn't talk to us" as a reason to bring him to trial you would not just be dismissed out of hand you would be chastised and probably censured. Exercising Constitutional rights is not something you can pretend can incriminate someone.

I agree you can’t take someone to trial because they would not talk to you, No the case in which Trump was ordered to give a deposition is not a criminal case.
