you seem to equate ruling via the constitution as defining the limits of the powers prescribed to the government. these are two very separate things clearly divided. the courts have no power to define the limits of their own power. only the constitution does that.

2. A person can own a tommy gun........as long as it meets the unconstitutionally enforced criteria.....did you not really know that machine gun possession is still legal? that's because an outright prohibition would be too far over the line for a government to get away with in these times.......
3. If it took a constitutional amendment to ban alcohol, then another constitutional amendment to make it legal again, how does the government get away with writing a simple law called the controlled substances act that allows an alphabet agency to dictate what people can and can't possess?????
