when this law was written and signed, it was already illegal for violent felons and mentally ill people to own weapons, so legislators already KNEW this and still exempted private sales. again NOT a loophole.A purposeful exemption becomes a loophole when unscrupulous buyers and sellers purposely circumvent the law... in this case...the law where violent felons and the mentally ill aren't allowed to own guns.
there is no possible way it can be a loophole if 'private sales' were purposefully exempted from having to do background checks. It was discussed and debated before the law was signed and YOUR congress concluded that to reduce the number of FFL's out there, thus reducing the number of people having access to NICS, that PRIVATE sales would not be required to do background checks. That is NOT a loophole.

Considering the new proposal didn't allow people access to the NICS....yeah it's a fair assumption that they haven't changed their policies.
