Was she allowed to use a private server? No.
Did Clinton seek government approval to use a private server for her personal email account? No.
Did Clinton have a government email account? No. The FBI said she declined to have one set up for her.
Did Clinton’s emails contain classified information? Yes. More than 2,000 of the 30,490 emails Clinton turned over to the State Department in December 2014 contained classified information, including 110 emails in 52 email chains that contained classified information at the time they were sent or received, Comey said. The FBI director said “a very small number” of the emails containing classified information “bore markings indicating the presence of classified information,” contrary to Clinton’s claims that none was marked classified.
Hillary is a lot of things but she isn't stupid. This wasn't an accident; she did it deliberately.
Was it illegal for her to use a private server? No. it is the Department’s general policy that normal day-to-day operations be conducted on an authorized [automated information system]. Her use of a private server would have gotten her a reprimand and possibly fired but it wasn't illegal.
So for over 1900 emails, the email was not deemed classified until long after they were sent. There is a dispute as to the classification of a lot of those emails, for instance where the CIA deemed a story from the NYTimes contained classified information so an email that included the story should have been classified.
Your opinion of what she did deliberately doesn't count unless she is charged and you are on a jury. Based on the evidence, Comey felt he couldn't prove what you think.
There is no question that Hillary did things that violated policy. That is not however illegal. Violating the policy results in a civil penalty.
