In boot camp I remember having been assigned by the company CO one of the 'tards in the company to tutor. There were several of us given this assignment, one-on-one. I was told my primary task wasn't to get this moron to be able to take the written tests on his own but rather to get him to memorize the answers as best he could then sit next to him during these tests and make sure he answered enough questions correctly to pass the exam. I was further told that the CO knew I (and the others selected) would easily breeze through these tests so we had the time to make sure our 'tard passed too.

In 19i8 the Supremes ruled a draft legal and constitution using the power to raise money for and declare war. They ruled the draft is a necessary part of that power.

Draft has been up before the SCOTUS numerous times and has been maintained as legitimate, just last July the Court refused to even hear a case involving it, all comes under implied powers

the government was not made the final arbiter of the constitution, nor was it given the power to define the limits of federal power.
 
Because that dodge has been tried numerous times now by those that don't want to be drafted. The two operative parts of the Constitution that apply to allowing a draft are first that the states can raise militia and that the militia consists, at least in theory, of all males 18 years of age or older. This is then coupled to Article I, section 8, clause 15 that permits Congress to call out the militia in time of war.

That in effect gives Congress the Right to call up all males 18 years or older, or some portion thereof, in time of war, insurrection, etc. So, a draft would likely be illegal in a period of peace with no declared war, or in a war that was not formally declared by congressional legislation. Thus, the draft is legal in times of war, and the 13th Amendment doesn't apply to the military in that situation.

Actually, the first draft was during the Revolutionary War. We have had many drafts since then.
The Revolutionary War was fought with a citizens army. It got its ass kicked during the war of 1812, with the Brits burning down the Whitehouse. We recognized the need for a standing and well-trained army. We have had drafts in the Revolutionary water, Civil War, WW1, WW2, Korea, and Vietnam.

I think he is weaseling by calling it militia as in citizens military groups. He cannot,by now, not understand that we have had 6 drafts.

With the way we have abused the military and decided that America is a horrible abusive place, and the way we have destroyed the schools and raised fragile adults, and with the way our youth dont do much physical activity anymore.......there is no option but to go to the draft.....and even then we wont get the quality we need to man our military.

Well of course they can raise a militia by hiring soldiers. We are talking about the draft AKA involuntary servitude.
 
I would like to see the draft come back, you can't have one segment of society during all the fighting and dying?!! There should not be any exemptions either, as medical or college?!! If you are medically unfit, you should do two years of community service around the country, only military doctors should decide if you are unfit to serve?!! No more bone spurs exemptions!


The draft should also apply to old people. Not that we should make 75 year olds fight, but they should be required to do community service - say 30 hours every week. I'd love to see billionaires picking up trash on a highway or cleaning a campground outhouse.

Now, what we couldn't have is something the Democrats and even Progressives--but not singularly--have repeatedly proposed, and that's a national service draft.
