On Tuesday, three Benton residents were arrested for the alleged rape of a juvenile.

Billy Joe Duke, 58, faces a class Y felony charge of rape. David Eugene Lewis, 36, and 33-year-old Tonya Lynn Lewis each face a class B felony charge of permitting abuse of a minor.

It is alleged that Duke had an inappropriate relationship with a 15-year-old since the victim was 11-years-old.

David and Tonya Lewis allegedly allowed the juvenile to live in the home of Duke for three months. All three suspects are being held in the Saline County Detention Center and are expected to appear before Benton District Judge Mike Robinson.

A grand jury indictment was issued for a man and woman charging them with forcible rape and child pornography.

Clayton D. Counts, 67, was charged with 15 felony charges, including seven counts of first degree statutory rape, three counts of forcible rape, three counts of forcible sodomy, possession of child porn and unlawful use of a weapon.

Judith E. Gray, 58, was charged with seven felony charges, including three counts of forcible rape, three counts of forcible sodomy and possession of child pornography.

According to Scott County Sheriff Rick Walter, these new charges are due to an ongoing investigation.

On Tuesday, January 26, Scott County deputies and officers with Alcohol, Tobacco and Firearms served a search warrant at Counts' home.

The search warrant was part of an ongoing investigation into a child molestation case.

During the search, deputies say they found an inappropriate picture of a girl younger than 18 years old in the bedroom of Counts and Gray.

The victim allegedly told investigators that Counts had taken the picture of her.

Officers also found a spent shell casing inside a drawer in the bedroom, along with ammunition and a shotgun inside a vehicle outside the home.

Counts is a convicted felon for a murder in 1988, along with other felony convictions, so he cannot possess a firearm.

Gray was allegedly present during incidents when Counts was allegedly raping the victim. Gray would allegedly hold the door shut in order to keep anyone from going inside the bedroom during the alleged rape.

A man whose houseguest apparently overdosed inside his residence dragged her body into his garage, loaded it into his Mercedes and dumped it along the side of a central Pennsylvania road on Valentine’s Day, authorities and his lawyer said.

Robert Moir told police that 35-year-old Corinne Pena died on his bathroom floor, and he left her body along a road, figuring it would be quickly found and wouldn’t decompose because of the low temperatures. He was charged Tuesday with abuse of a corpse.

Moir’s attorney, James Bryant, described Pena as a houseguest who “died on him.”

An Oregon woman has been sentenced to life in prison for throwing her autistic 6-year-old son over 100 feet to his death from a bridge.

Jillian McCabe, 36, pleaded guilty to murdering her son London, District Attorney Michelle Branam said in a statement.

McCabe “was very calculated” in planning the homicide weeks in advance, Branam said, leaving behind a trail online and in phone records that showed she had researched legal defenses based upon findings of insanity and also appeared to fake mental illness and manipulate doctors.

“Based on the searches on her phone, you could surmise Jillian planned to murder London by throwing him off the bridge and to get committed to the State hospital,” Branam said.

She added that, at one point, McCabe searched online: “Can you die falling 133 ft in water?”.

A Great Falls man who pleaded guilty to a sex offense against a 13-year-old girl was sentenced Friday morning to 40 years in prison.

Shaun Allen Downs, 33, changed his plea to one count of sexual intercourse without consent. According to court testimony, Downs admitted having sex with the girl.

Dr. Michael Scolatti completed the defendant’s psychosexual evaluation for the presentence investigation. Prosecutor Josh Racki asked Scolatti about statements Downs made that were included in the sealed report, specifically that Downs indicated the girl initiated the sexual contact.

“He said he initiated once,” Scolatti read from the report, adding that Downs said the victim “seemed to be happy afterward.”

“Did he think he was doing her a favor?” Racki asked in response.

“Yes.”

Daniel Hughes, who was found not guilty of sodomy and child molestation for the mix-up, said he thought the nine-year-old he cuddled was a woman he had met earlier in the evening.

Though he was cleared of charges of child molestation and sodomy, he claims he lost his high-powered job, and now he is suing the Ritz-Carlton.

Pleasant Grove police arrested a man on suspicion of raping a woman he met on Tinder.

She reportedly told police she met the suspect, Alex Stringfellow, on Tinder, a mobile dating app.

For a while, the two would message back and forth casually until Stringfellow, 20, asked if she wanted to go on a date with him.

The victim, a recently returned missionary for The Church of Jesus Christ of Latter-day Saints, was initially unsure, but she knew another male who served his LDS mission with Stringfellow and confirmed he was “a good guy,” police reports state.

Stringfellow told the victim he wanted to go look at the stars with her, so he drove the two to Kiwanis Park in Pleasant Grove, reports state.

Stringfellow became aggressive and took his pants off, though she told him “we are not having sex,” reports state.

Stringfellow took the victim’s pants off and began to rape and sexually assault her, though she tried to push him off and tell him to stop, at least six times, police reports state.

A killer who shot a man on a Manhattan street after hurling gay epithets has a longtime transsexual lover who insists the defendant is no bigot.

Elliot Morales, acting as his own lawyer for the hate-crime slaying of gay stranger Mark Carson, called as his first witness a former flame whom he’d met online.

The 38-year-old transsexual woman, using the pseudonym Jane Smith, testified from behind a curtain in Manhattan Supreme Court that she and Morales, 36, had a physical relationship on and off for 10 years.

Andrew Chatwin watched as federal agents and sheriff’s deputies swarmed this rural polygamist outpost last week, storming dairy and produce stores and a food distribution center in bulletproof vests, guns drawn, handcuffs dangling from their belts.

“I thought this day would never come,” said Mr. Chatwin, 48, a former member of the Fundamentalist Church of Jesus Christ of Latter Day Saints, the sect that rules the hearts and minds of followers here and across the state line in Colorado City, Ariz.

According to prosecutors, the businesses were key players in a high-desert conspiracy that siphoned millions of dollars in food-stamp benefits from the pockets of needy American families to bank accounts controlled by the polygamist sect, whose leaders — most prominently, the jailed Warren Jeffs — follow a self-styled form of Mormonism and dictate where followers live, how much they eat and whom they marry.

The arrests are only part of the legal troubles confronting the sect and its home-base communities, accused in a federal civil rights trial unfolding in Phoenix of denying housing, utilities and adequate policing to nonbelievers. In closing arguments on Wednesday, the defense argued that the government was using the towns as scapegoats to seek revenge against a religion it abhors.
