New York state does not have a death penalty. It was abolished in 2004 when the New York Court of Appeals declared the state's death penalty statute unconstitutional. Since then, no efforts to reinstate it have succeeded, and in 2008, Governor David Paterson issued an executive order to disestablish New York's death row
