If you are stipulating that the representatives are chosen by such a vote, you are declaring that the representatives are chosen democratically. If, at such a time, a State decides to determine senators by some other means, then the senators will cease to be elected democratically and will become "appointed."

A democracy is not an oligarchy, but it easily dissolves into one. That or a dictatorship (less common). A democracy is an unstable form of government.
