States can pass such laws, if it's in their constitutions. The federal government cannot pass such a law due to the 1st amendment forbidding it. Currently, in Washington State, the legislature could pass such a law.

Burning a flag is not 'speech'. It is not a text, or spoken, one of two things required for it to be considered 'speech' under the Constitution of the State of Washington.
Under the U.S. Constitution, the States are currently interpreting 'speech' to include burning a flag. That may change over time, as burn a flag is stretching the concept of 'speech' quite a bit.
I respectfully disagree. I completely agree with with a persons rights in this country. Not when it comes to that though.
